What is a DIP (Product Information File) in cosmetics?

The Product Information File (DIP) guarantees the safety and conformity of cosmetic products placed on the market.

This is a set of documents detailing the characteristics, composition and tests carried out on a cosmetic product.

This dossier is essential to ensure transparency and consumer confidence in the products they use on a daily basis.

What are the constituent elements of private international law?

The DIP contains several pieces of information about the cosmetic product.

It includes a precise description of the product, including its qualitative and quantitative composition, physico-chemical and microbiological specifications, as well as manufacturing and packaging methods.

In addition, it contains the product safety report, which assesses potential risks to human health.

This report is prepared in accordance with Annex I of the European cosmetics regulation.

Finally, the Product Information File includes evidence of the effects claimed by the product, such as efficacy test results, and data relating to animal experiments, where applicable.

Who is responsible for the constitution of the DIP?

The responsibility for the creation and maintenance of the DIP lies with the Responsible Person, generally the manufacturer, cosmetic laboratory or distributor who places the product on the market under their name or brand.

This person must ensure that the Product Information File is complete, complies with regulatory requirements and is accessible to the competent authorities for a period of 10 years from the date of placing on the market of the last batch of product.

It is therefore crucial that the Responsible Person has the necessary skills or calls upon experts to develop a DIP that complies with current standards. 

Why is the DIP mandatory in Europe?

Since the entry into force of Regulation (EC) No 1223/2009 on 11 July 2013 , the establishment of a DIP is mandatory for any cosmetic product placed on the European market.

This obligation aims to guarantee consumer safety by ensuring that each product has been rigorously evaluated and documented.

The Product Information File allows authorities to verify product compliance and take action in case of non-compliance with standards. Therefore, it plays a crucial role in regulating the cosmetics market and protecting public health. 

What are the consequences of an incomplete or non-compliant DIP?

An incomplete or non-compliant Product Information File can lead to sanctions for the Responsible Person, ranging from product withdrawal from the market to financial fines.

The relevant authorities, such as the DGCCRF in France, carry out regular checks to ensure the compliance of cosmetic products. In the event of a breach, they can order immediate corrective measures.

Furthermore, a non-compliant Disclosure Document (DIP) can damage a brand's reputation and erode consumer confidence. Therefore, ensuring the quality and completeness of the DIP is crucial to avoid such consequences. 

How can we ensure the updating and availability of the DIP?

The DIP must be updated regularly to reflect any changes to the product, whether it be its composition, manufacturing process, or new safety data.

The Responsible Person must ensure that the Product Information File is accessible to the competent authorities at the address indicated on the product labelling.

It is recommended to keep the Product Information File (PIF) in a secure electronic format, thus facilitating its updating and accessibility. Rigorous management of the Product Information File helps maintain regulatory compliance and ensure consumer safety.
